CINA Disposition
hearing
The dispositional hearing is the time in which the
Court determines which services will be required by
court order for the children.
The Department of Human Services generally makes
recommendations to the County Attorney, and the
county attorney then makes her recommendations to
the Court. Then the parents and their attorney have
the opportunity to make an argument.
Also, Guardian ad Litem will have the chance to
submit a report and make a recommendation.
The Court will consider all of the arguments and will
ultimately make a decision that is deemed in the best
interest of the child.
These services may include parenting classes for the
parents, substance abuse evaluation and treatment
for the parents, psychological counselling for the
parents or children, requirements that the parents
maintain safe housing for the child, and many other
requirements.
Basically the Court will require that the parents fix
whatever problem was alleged in the petition, and
follow through with all of the DHS services until the
child is no longer in danger.
Next a review hearing is scheduled. If the hearing is
ex-parte, then only the judge will be present. If an
in-court review is scheduled, then all parties must be
present.
Once the judge has determined that the harm or
problem has been taken care of and the child is out of
danger, the case will be closed and there will be no
more interaction with the court or the DHS.
